Recovery & Enforcement Disclaimer

- We do not exercise judicial powers or guarantee enforcement success.
- All recovery actions are subject to borrower conduct, court orders, regulatory approvals, and statutory timelines.
No assurance is given regarding recovery amounts, timelines, or outcomes.
Borrower Interaction & Conduct Policy
CMC strictly adheres to:
- RBI Fair Practices Code
- SARFAESI Rules and guidelines
Any form of coercion, intimidation, harassment, or unlawful conduct is strictly prohibited.
Users acknowledge that recovery actions are conducted lawfully and professionally.
Property, Auction & Asset Sale Disclaimer
- Property details, auction notices, and valuation information are provided as received from banks or statutory authorities.
- CMC does not guarantee physical condition, encumbrance-free title, or possession timelines.
- Buyers must conduct independent legal, financial, and technical due diligence before participating in any auction or purchase.
CMC shall not be liable for post-sale disputes or title-related claims.
Financial Transactions & Payments
- All payments must be made only through authorized banking channels.
- Cash transactions are strictly prohibited.
- CMC shall not be responsible for failed or delayed payments caused by banking systems or third-party gateways.
Taxes, Duties & Statutory Charges
- Applicable GST, stamp duty, registration charges, and statutory fees shall be borne by the client or buyer, as applicable.
- CMC does not provide tax advisory services.
Refund, Cancellation & Adjustment Policy
- Due to the nature of professional and legal services, no refunds or cancellations are permitted once services have commenced.
- Fees paid for partially or fully executed services are non-refundable.
- Any financial adjustment shall be governed strictly by written agreements.
Confidentiality & Non-Disclosure
- All information shared between CMC and clients shall remain confidential.
- Users shall not disclose proprietary processes, documents, or data without prior written consent.
- This obligation survives termination of engagement.
Indemnity & Hold Harmless
Users and clients agree to indemnify and hold harmless CMC, its directors, employees, and agents against:
- Legal claims arising from misuse of services
- Third-party disputes or borrower claims
- Breach of law, misrepresentation, or contractual violation
Force Majeure
CMC shall not be liable for delays or failure due to events beyond reasonable control, including:
- Court or tribunal orders
- Government restrictions
- Natural disasters, pandemics, strikes
- Technical or system failures
Limitation of Liability
To the maximum extent permitted under law:
- CMC shall not be liable for indirect, incidental, or consequential damages
- Liability, if any, shall not exceed the fees paid for the specific service
Suspension & Termination
CMC reserves the right to suspend or terminate access or services without prior notice in cases of:
- Legal violations
- Misrepresentation or fraud
- Reputational or compliance risk
Intellectual Property Rights
